How do I place an order

In order to place an order you will have to firstly register your information in order to obtain a User Account, always indicating a valid billing address and delivery address. The Shopping Basket contains all the selected articles, with it’s correspondant name, unit price, quantity, total price per producto and final price of order. The sale prices indicated in the Fambuena web are expressed in euros (EUR €) including de 21% of TAX, except the contrary mention of the buyer who posseses a registered intra-community TAX number.

Once the payment of the order is confirmed by the bank entity, there will be a communication through the web of the preparation and there will be a summary displayed in their User Account.

All orders are subject to the availability of the products that comprise it. If we do not have items in stock, you will be provided with information via email about similar products that are available.

Fambuena expresses its right to the modification with no previous notice of the prices, as well as the commercial offers presented in our web related to products, promotions, and other commercial conditions and the service in any case. As a user you shall check with previous character before requesting any product or service regarding the conditions of the offer.

Fambuena could, in certain occasion, display provisional information regarding certain products. In the case that the facilitated information does not correspond to the characteristics of the product, you will have the right to terminate your purchase without having to incur further payments.

In the case of the existance of import and/or Custom formality fees, these payments will correspond to the buyer.

Payment Methods

The payment of the selected products will be made through the system of payment available on the Platform like credit card and Paypal. The payment shall be confirmed by the corresponding bank entity. In order and effect that Fambuena can carry out the correct steps, you shall notify in the least time possible of any improper fraudulent charge in the payment method utilised for the purchase on which the infringement has occured.

If the notification fails to be recieved in 24 hours it will expose Fambuena of any responsibility respecting the refund.

In order for the purchases you do on our web be deemed as safe, we use authorised payment agents that help us validate directly with your bank that the card is valid for the purchase. Our payment agents will process the details of the card according to the standards of international security, developed by the bank companies VISA. With this, we certify that the details of your card are processed with a high level of security. Shipping and Deliveries

For deliveries within Spanish territory the usual delivery time oscillates between 5 to 8 business days after the exit of our factory for stock products. If you need to consult the stock of our products, get in contact with us.

For international deliveries of European ambit the usual delivery time oscilliates between 8-12 business days, after the exit of our factory for stock products, depending on the country. If you need to consult the stock of our products, get in contact with us.

Fambuena will make a delivery through an air or land Courier service. Once the order has been dispatched, you will recieve an email indicating the transport company, and order tracking number. The sealed merchandise and properly secured, will be               delivered to the address indicated by the Client, except Saturdays, Sundays and festive days.

Fambuena will not take responsibility of the possible delays due to causes beyond their control, in the delivery of your order.

Once you have recieved the merchandise, the Client shall check the state in the moment of delivery. In the case it is recieved sealed properly, they shall re-use the delivery. If possible, and without prejudice of the current legal warranties, try to open the merchandise in the presence of the agency in charge of your transport and if you see any in bad state, indicate it on the delivery note with your signatura.

 

Returns

The provisions of the Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law of Defense of Consumers and Users and other complementary laws will be followed.

You will dispose of 14 business days since the reception of the order to return the order. You will have to communicate Fambuena within the stipulated time and any other medium admited in right, your right to withdrawl.

Keep in mind that there will be no refund if the product has been used outside the opening of the product, of products that are not in the same conditions in the ones that they were delivered or that has suffered any damage, which means you shall be cautious with the product/s while they are in your possesion. Please, return the using or including the original wrappings, the intrucctions and the documents if these accompany it.

In these cases Fambuena will return the money of the purchase through a credit using the same payment method used in your purchase. Fambuena will not return the amount nor will we make reshipment of merchandise receipt and condition of the packaging accessories of the item being returned has been verified.

Conditions that regulate the refund of the producto

Right to Withdrawl

In accordance to applicable regulations, in the case the User has been contracted as consumer, they can desist of the contract (except in the cases established by law) and return freely the Products delivered in any moment within the 14 natural days since the delivery thereof (the “Withdrawl Period”). The refered right of withdrawl will not be valid respecting those products that have been made up according to the specifications by the Buyer or clearly personalised.

The communication and management of the withdrawl, must be carried out within the mention period by sending an email to; online@fambuena.com.

The refund fees are the client’s responsibility.

There will be no refund if the product has been used furthermore after the mere apperture of the product, the products that are not in the same conditions as they were delivered or that have suffered damage, meaning the client shall be cautious with the product/s while they are in their possesion. Likewise, the returned ítems shall include all its original wrappings, the instructions as well as documents that may accompany them.

Once the pertinent inspection of the returned Product Fambuena will refund the User the correspondent cost, except the return costs, in the same payment method used in the purchase and within a maximum period of 14 days.

Fambuena will not return the amount or make any reshipments of merchanside until the receipt and conditions of packaging and accessories of the item being returned has nos been verified.

Once the Period of Withdrawl has elapsed, returns of the Products will not be accepted. Changes will only be accepted for those Products that could have been defective in accordance with the provisions of section b. following

1. Defective producto from origin

Fambuena will effectuate a change of the same product or reference once recieved the defective product. In this case, only the first shimpent will be billed, Fambuena taking charge of the correspondent costs of the return and new delivery. In the case you would like to effectuate a change for a different article or reference, you will asume the cost of return and new shipment. In the event of deterior of the producto due to transport, you shall notify Fambuena in the course of 48 hours posterior to the reception of shipment via email to: info@fambuena.com

1. Wrong Product

Fambuena will take responsibility of the pickup fees of the wrong product and the delivery of the correspondant of the order.

Warranties

If you contract as a Consumer and User, you will be subject to the provisions of Royal Legislative Decree 1/2007, of November 2016, which approves the consolidated text of the General Users Law and the applicable regulations for each type of product.

In those incidents that justify the use of the warranty, the repair, replacement of the article, reduction or return will be chosen, in the established legal terms.

It is understood that the products are in accordance with the contract provided that (i) they conform to the description made by us on the Platform, (ii) they are suitable for the ordinary use that the products of the same type are used for and (iii) present the habitual quality and benefits of the producto of the same type that are fundamentally expected.

In this sence, if any of the products are not conformed with the contract, you shall acknowledge it to us immediately and, not taking longer than 48h after opening the package,  facilitating all the product data, as well as the damage suffered.
The amounts paid for those products that are returned due to a flaw or defect, when it actually exists, will be fully reimbursed, including the delivery costs incurred to deliver the item and the costs you would have incurred to return it to us. The return will be made in the same means of payment that was used to pay for the purchase. In any case, the rights recognized by current legislation are protected.

 

Disclaimer

Fambuena disclaims any type of responsability derived from the information published on our web whenever the information has been manipulated or introduced by any third party outside the organisation.
Likewise, we will not be responsible for any breach or delay in the fulfillment of any of the assumed obligations, when it is due to events that are beyond our reasonable control (Cause of Major Force). The Causes of Major Force will include any act, evento, lack of exercise, omission or accident that are beyond our reasonable control, and among others, the following;

1. Strikes, lockouts or other protest measures.2. Civil commotion, riot, invasion, terrorist threat or attack, war (declared or not) or threat or preparations for war.3. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.4. Impossibility of using trains, ships, planes, motor transport or other means of transport, public or private.5. Impossibility of using public or private telecommunications systems.Acts, decrees, legislation, regulations or restrictions of any government or public authority.

 

There will be an understanding that the obligations will be suspended during the period of the Cause of Major Force, and will obtain an extension in the terms to fulfill said obligations for a period of time equal to the Cause of Major Force. We will use all reasonable means to finalise Cause of Major Force or find a solution that will allow us to fulfill our obligations despite the Cause of Major Force.

 

Governing Law and Jurisdiction

For the resolution of all disputes or issues related to the Fambuena website or the activities developed therein, Spanish legislation will apply, to which the parties expressly submit, being competent to resolve all disputes arising or related to its use the Courts and Tribunals closest to VALENCIA.
